MoxyTox Terms and Conditions

Welcome to MoxyTox. By booking our services or purchasing packages, you agree to the following terms and conditions. Please read them carefully.

1. Amendments to Terms and Conditions

MoxyTox reserves the right to amend or modify these Terms and Conditions, including our policies and procedures, at any time. Any such changes will be posted on our website. Your continued use of our services following any changes signifies your acceptance of those changes.

2. Consent to Receive Electronic Communications

By providing your email or phone number to MoxyTox, you consent to receive electronic communications, including appointment reminders, promotional offers, and updates about our services. You can opt out at any time by contacting us at [email protected].

3. Sales and Refund Policy

All sales are final. No refunds will be issued for any services or packages purchased. Please make sure you fully understand and agree to the service before proceeding with the purchase.

4. Before and After Photos

As part of our commitment to showcasing real results, MoxyTox may take before and after photos of your treatment area. These photos may be used in our gallery on the MoxyTox website and social media platforms. Rest assured, no identifying information will be shared or associated with your images.

5. Payment and Packages

• Payment: All packages must be paid for in full at the time of purchase.

• Validity: Packages must be completed within 12 months from the date of purchase. Any unused services within this timeframe will be forfeited without a refund.

• Single Service Appointments: Individual services require a $50 deposit at the time of booking. This deposit will be applied to your treatment cost.

• Cancellation Policy: If you need to cancel or reschedule an appointment, please do so at least 24 hours in advance. Failure to cancel within this time frame will result in the forfeiture of your $50 deposit.

6. Referral Program

All clients are automatically enrolled in our referral program. For every client you refer, you will receive 10% of what your referred client spends at MoxyTox, which can be applied toward your next paid service. This credit will be automatically applied to your account once the referred client completes their appointment.

7. Promotions

• First-Time Client Offer: New clients are eligible for one free Morpheus treatment (valued at $600) on the face, neck, or chest area of your choice when you make a purchase of $400 or more. This Morpheus treatment must be completed during your first visit.

• Morpheus Treatment with Packages: Any package purchase of $2,000 or more paid upfront includes one free Morpheus treatment (valued at $600) on the face, neck, or chest area. Additionally, you’ll receive discounted pricing for future Morpheus treatments for the same area.

• Package Discount: Packages valued at over $700 are eligible for a 10% discount when paid upfront.

8. Service Excellence

At MoxyTox, we strive to deliver the highest standard of care and aesthetic treatments tailored to your unique needs. Your satisfaction and comfort are our priority.

9. Liability Waiver

MoxyTox provides aesthetic treatments with the highest standard of care. However, by booking an appointment and receiving services, clients acknowledge and accept that there are risks associated with all aesthetic treatments. MoxyTox, its staff, party hosts, and contractors will not be held liable for any adverse effects, injuries, or dissatisfaction resulting from treatments. Clients should consult their personal physician if they have any medical concerns before undergoing treatment.

10. Medical Disclaimer

All services provided by MoxyTox are intended for cosmetic purposes only and are not a substitute for medical treatment. Any information provided by MoxyTox should not be construed as medical advice. Please consult with your healthcare provider for any medical concerns.

11. Privacy Policy

Clients’ personal and medical information is kept strictly confidential. MoxyTox will not share any personal data with third parties without explicit consent, except where required by law. Please review our Privacy Policy for more detailed information about how we collect, use, and protect your data.

12. Age Requirement

Clients must be at least 18 years of age to receive any treatments from MoxyTox. By booking an appointment, you confirm that you meet this age requirement. Parental consent is required for clients under the age of 18 seeking certain services, and proof of age may be requested.

13. Payment Methods

MoxyTox accepts various payment methods, including major credit cards, debit cards, and online payment options. All payments must be completed at the time services are rendered or as specified under package terms.

14. Health Conditions

It is the responsibility of the client to inform MoxyTox of any pre-existing health conditions, allergies, or medications being taken that could affect their treatment. Clients must disclose any conditions such as pregnancy, breastfeeding, skin conditions, or other medical concerns that might impact the outcome of their treatment.

15. COVID-19 and Other Health Protocols

Clients are required to follow any health and safety protocols set by MoxyTox, including but not limited to wearing masks, completing health questionnaires, and informing the team if they have been exposed to contagious diseases or are feeling unwell. MoxyTox reserves the right to reschedule appointments in the event of illness for the safety of clients and staff.

16. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the state of Georgia, without regard to its conflict of law principles. Any disputes arising from the use of MoxyTox services or the terms outlined here will be resolved in the courts of Fulton County, Georgia.

17. Results Disclaimer

Results from aesthetic treatments can vary from person to person. MoxyTox makes no guarantees about the final results of treatments. Factors such as individual skin types, adherence to post-care instructions, and health conditions can affect outcomes.

18. Client Responsibility

It is the client’s responsibility to follow all pre-treatment and post-treatment care instructions provided by MoxyTox. Failure to follow these instructions may impact the results and lead to complications, for which MoxyTox will not be held responsible.

19. Consultation and Informed Consent

Prior to undergoing any treatment, clients will be required to participate in a consultation with a qualified provider. During this consultation, clients will be informed of the benefits, risks, alternatives, and potential outcomes of the proposed treatment. By proceeding with treatment, clients acknowledge that they have provided informed consent.

20. Allergic Reactions and Medical History

It is the client’s responsibility to disclose any allergies or medical conditions prior to treatment. MoxyTox will not be responsible for any adverse reactions resulting from the failure to disclose relevant medical history or allergies.

21. Product Liability

Any products recommended or sold by MoxyTox (e.g., skincare products, supplements) are intended for personal use only. MoxyTox will not be held liable for any adverse reactions or ineffective results stemming from misuse or failure to follow instructions regarding product usage.

22. Emergency Protocols

In the event of a medical emergency during a treatment session, MoxyTox staff will take all necessary actions, including calling emergency services if required. Clients are encouraged to inform the staff of any emergency contacts or specific medical needs that should be considered in the case of an emergency.

23. Gift Certificates and Vouchers

Gift certificates and promotional vouchers are non-refundable and must be redeemed within their stated validity period. They cannot be exchanged for cash or transferred to another individual without prior approval from MoxyTox.

24. Treatment Expiry and Transferability

• Package Expiry: All packages must be used within 12 months from the date of purchase. Any unused services after this period will be forfeited.

• Transferability: Services and packages are non-transferable unless explicitly agreed upon by MoxyTox.

25. Intellectual Property

All content provided on the MoxyTox website, including but not limited to text, images, logos, and graphics, is the intellectual property of MoxyTox. Unauthorized use or reproduction of any content from the website is prohibited without prior written consent.

26. Dispute Resolution

Any disputes or claims arising from or relating to these Terms and Conditions or MoxyTox services will be settled through binding arbitration in accordance with the rules of the American Arbitration Association. Any such disputes will be resolved individually and not as part of a class action or other representative proceeding.

27. Indemnification

You agree to indemnify and hold MoxyTox, its affiliates, employees, party hosts, and agents harmless from any claims, liabilities, damages, or expenses arising out of your use of our services, breach of these Terms and Conditions, or any violation of applicable laws or third-party rights.
